2. Use of the Site

1. Eligibility: You must be at least 18 years of age to use the Site and enroll in Courses. By using the Site, you represent and warrant that you are 18 years of age or older.
2. Account Creation: To access certain features of the Site or to enroll in Courses, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3. Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Thespian Heights Academy immediately of any unauthorized access to or use of your account.
4. Prohibited Conduct: You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You also agree not to:
   • Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
   • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
   • Interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site.
   • Attempt to gain unauthorized access to any portion of the Site or any other accounts, computer systems, or networks connected to the Site.

3. Course Enrollment and Payment

1. Enrollment: Enrollment in Courses is subject to availability and acceptance by Thespian Heights Academy. Thespian Heights Academy reserves the right to refuse enrollment to any applicant.
2. Tuition and Fees: Tuition and fees for Courses are posted on the Site and are subject to change without notice. You are responsible for paying all tuition and fees associated with your enrollment.
3. Payment Methods: Thespian Heights Academy accepts various forms of payment, as indicated on the Site. You agree to provide accurate and complete payment information.
4. Cancellation and Refunds: Cancellation and refund policies for Courses are outlined separately and provided to students upon enrollment. Please review these policies carefully. Generally, a full refund (less a small administrative fee) is provided if cancellation is made before the course's start date. Partial refunds may be available for cancellations made after the course has started, depending on the specific course and the amount of material covered. No refunds will be provided for missed classes.

4. Intellectual Property

The Site and its content, including but not limited to text, graphics, logos, images, and software, are the property of Thespian Heights Academy or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content on the Site without the express written permission of Thespian Heights Academy.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Thespian Heights Academy shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or your enrollment in Courses, even if Thespian Heights Academy has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses.

6. Disclaimer of Warranties

The Site and Courses are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Thespian Heights Academy disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Thespian Heights Academy does not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components.

7. Indemnification

You agree to indemnify, defend, and hold harmless Thespian Heights Academy, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or your enrollment in Courses, your violation of these Terms, or your violation of any rights of another person or entity.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Los Angeles County, California.

9. Changes to Terms

Thespian Heights Academy reserves the right to modify these Terms at any time without notice. Your continued use of the Site or your continued enrollment in Courses after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for any updates or changes.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity or enforceability of the remaining provisions.

12. Entire Agreement

These Terms constitute the entire agreement between you and Thespian Heights Academy with respect to the Site and Courses and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Thespian Heights Academy.
